In the US, surrogacy contracts are legal and enforceable in California, Texas, Tennessee, and Utah, while other states may have more limited provisions. In some states, such as New York, surrogacy contracts are not enforceable. Couples seeking a surrogate mother in the US should carefully research state laws before signing a contract.
